These Terms of Use ("Terms") govern your access to and use of the website located at jpstreeservice.com (the "Site") and the services provided by JPS Tree Service ("JPS Tree Service," "we," "us," or "our").
By accessing our Site, requesting services, or hiring JPS Tree Service, you agree to these Terms. If you do not agree, please do not use our Site or services.
1. About JPS Tree Service
JPS Tree Service is a family-owned tree care company based in Pontiac, Michigan, offering residential, commercial, utility, and environmental tree services throughout Michigan, including (but not limited to) Detroit, Sterling Heights, Warren, Troy, Livonia, Dearborn, Southfield, Rochester Hills, Grand Rapids, Wyoming, Kentwood, Rockford, Walker, Ann Arbor, Ypsilanti, Saline, Chelsea, Lansing, East Lansing, Okemos, Kalamazoo, and Portage.

2. Site Use and Eligibility
You must be at least 18 years old to request services or enter into any contract with JPS Tree Service. By using our Site or requesting services, you represent and warrant that:
- You are at least 18 years old
- You have the legal authority to enter into binding agreements
- You are the property owner or have express authorization from the property owner to request tree services on the property in question
- All information you provide is accurate, current, and complete
3. Free Estimates and Service Quotes
We provide free, no-obligation estimates for our services.
3.1 Estimate Terms
- Estimates are provided in writing (via email or printed form) and itemize the scope of work and price
- Estimates are valid for 30 days from the date issued unless otherwise stated
- Estimates may be revised if site conditions change, additional work is requested, or hidden hazards (e.g., decay, wasp nests, embedded metal) are discovered after work begins
- Verbal estimates over the phone are preliminary and subject to confirmation after an on-site inspection
3.2 Acceptance
An estimate becomes a binding service agreement only when:
- You sign or provide written acceptance (including by email), OR
- Work begins with your authorization
4. Service Agreement and Scope of Work
Once an estimate is accepted, the following terms apply:
4.1 Scope
Work performed will match the written estimate's scope. Additional work requested during the job will be billed separately at our prevailing rates and confirmed before being performed.
4.2 Property Access
You agree to provide reasonable access to the property and the trees, shrubs, or areas where work will be performed. You are responsible for moving vehicles, lawn furniture, and other personal items from the work area unless otherwise agreed.
4.3 Permits and HOA Approvals
You are responsible for obtaining any permits, HOA approvals, or property owner permissions required for the work. If permits are required by local ordinance (e.g., for tree removal in certain Michigan municipalities), we can advise you, but the responsibility for obtaining them is yours.
4.4 Underground Utilities
Before any stump grinding, excavation, or root work, you are responsible for ensuring that underground utilities (gas, water, electric, fiber, irrigation, septic) have been located and marked. In Michigan, this is done by calling MISS DIG at 811 or visiting missdig811.org. JPS Tree Service is not liable for damage to unmarked or incorrectly marked underground utilities or private utilities (sprinklers, invisible fence, landscape lighting) unless we agreed in writing to locate them.
5. Pricing, Payment, and Invoicing
5.1 Pricing
All prices are in U.S. dollars and exclude applicable taxes unless stated otherwise.
5.2 Payment Terms
Unless otherwise agreed in writing:
- Payment is due upon completion of the work for jobs under $1,000
- Larger jobs may require a deposit (typically 25-50%) before work begins, with the balance due on completion
- We accept cash, check, debit card, credit card, and electronic payment (Venmo, Zelle, ACH); credit card payments may incur a processing fee
- Past-due invoices accrue interest at the lesser of 1.5% per month or the maximum allowed by Michigan law
- Returned checks are subject to a $35 fee plus any bank charges
5.3 Cost Adjustments
Final cost may differ from the estimate if:
- The scope of work changes at the customer's request
- Site conditions differ materially from what was visible during the initial inspection (e.g., interior decay, embedded debris, wasp/hornet nests)
- Emergency or after-hours service is required
- Weather requires return trips
We will notify you and obtain approval before performing additional work that increases the cost.
5.4 Cancellation
If you cancel a scheduled job:
- More than 48 hours in advance: no charge
- Less than 48 hours in advance: 25% of the estimate may be charged to cover scheduling and crew preparation
- After the crew has arrived on site: 50% of the estimate may be charged
6. Warranties and Limitations
6.1 Workmanship
We warrant that our services will be performed in a workmanlike manner consistent with industry standards (ANSI A300 for pruning, ANSI Z133 for safety) by trained and ISA-certified arborists.
6.2 Tree Health
We do not warrant that:
- A tree we treat for a disease (e.g., Emerald Ash Borer, oak wilt) will survive
- A tree we prune will not fail in a future storm
- Newly planted trees will survive their first season (though we offer optional replacement guarantees, sold separately)
Tree health depends on many factors outside our control, including weather, soil conditions, prior damage, and pest pressure.
6.3 Disclaimer
EXCEPT FOR THE EXPRESS WARRANTIES STATED HERE, JPS TREE SERVICE DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
7. Risk and Liability
7.1 Inherent Risks of Tree Work
Tree work involves inherent risks, including:
- Falling branches or debris
- Damage to nearby property (lawn ruts from equipment, minor turf damage, etc.)
- Disturbance to underlying ground and root systems
- Noise, dust, and temporary disruption
By engaging our services, you acknowledge these risks and accept reasonable consequences such as lawn impressions from equipment, minor turf disturbance, and inability to fully prevent all debris.
7.2 Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY MICHIGAN LAW, JPS TREE SERVICE'S TOTAL LIABILITY ARISING FROM OR RELATED TO THE SITE OR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.
IN NO EVENT SHALL JPS TREE SERVICE BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL.
This limitation does not apply to liability that cannot be limited under Michigan law (e.g., gross negligence, willful misconduct, personal injury caused by our negligence).
7.3 Insurance
JPS Tree Service carries general liability and worker's compensation insurance. A Certificate of Insurance is available upon request.
7.4 Customer's Responsibility
The customer is responsible for:
- Damage to unmarked underground utilities (see Section 4.4)
- Damage caused by failure to disclose hazards (decay, weak unions, embedded metal)
- Damage caused by failure to clear the work area as agreed
- Personal injury to the customer or other parties who enter the work zone after being asked to stay clear
8. Emergency Services
We provide 24/7 emergency tree service across our Michigan service area.
- Emergency response is billed at our prevailing emergency rates, which are higher than standard rates due to after-hours dispatch, crew availability, and risk
- A written estimate may not be provided before emergency work begins if delaying poses a safety risk; in such cases, we will provide a verbal estimate and a written invoice after the work is completed
- Calling for emergency service constitutes acceptance of emergency rates

9. Site Content and Intellectual Property
All content on the Site — including text, graphics, logos, photos, videos, software, and design — is owned by or licensed to JPS Tree Service and protected by U.S. and international copyright, trademark, and other intellectual property laws.
You may:
- View and download Site content for personal, non-commercial use
- Share links to our Site on social media or in correspondence
You may not:
- Copy, reproduce, distribute, modify, or republish Site content for commercial purposes without our written permission
- Use our name, logo, or trademarks without permission
- Scrape, harvest, or use automated tools to extract data from the Site
- Reverse-engineer or attempt to access the underlying code of the Site
10. User-Submitted Content
If you submit reviews, photos, testimonials, or other content to us (via email, social media, the Site, or otherwise), you grant JPS Tree Service a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, modify, and display that content in our marketing, on our Site, and in other business communications.
You represent that you own the content or have the right to grant this license, and that the content does not infringe any third-party rights.
11. Reviews and Public Feedback
We welcome honest reviews on Google, Facebook, Yelp, and other public platforms. By posting a review, you agree that:
- The review reflects your honest opinion
- We may quote or reference public reviews in our marketing materials
- We may respond to reviews publicly to clarify facts, thank reviewers, or address concerns
- Defamatory or false reviews may be subject to legal action under Michigan law
12. Prohibited Conduct
You agree not to:
- Use the Site for any unlawful purpose
- Interfere with the security or functionality of the Site
- Impersonate any person or misrepresent your affiliation
- Submit false service requests or harassing communications
- Use the Site to send spam or unsolicited communications
- Access the Site through any automated means (bots, scrapers, etc.) except for legitimate search engine indexing
13. Third-Party Links
Our Site may link to third-party websites (Facebook, Google, Instagram, payment processors, etc.). We are not responsible for the content, accuracy, or practices of those sites. Linking to a third-party site does not imply our endorsement.
14. Indemnification
To the fullest extent permitted by Michigan law, you agree to defend, indemnify, and hold harmless JPS Tree Service and its owners, employees, contractors, and affiliates from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising from:
- Your violation of these Terms
- Your misuse of the Site or services
- Your violation of any third-party rights
- Your provision of false or misleading information
15. Termination
We may suspend or terminate your access to the Site at any time, without notice, for any reason, including violation of these Terms.
Termination does not affect any rights or obligations that arose before termination.
16. Governing Law and Disputes
16.1 Governing Law
These Terms are governed by the laws of the State of Michigan, without regard to its conflict-of-laws principles.
16.2 Venue
Any legal action arising from these Terms or our services shall be brought exclusively in the state or federal courts located in Oakland County, Michigan. You consent to the personal jurisdiction of those courts.
16.3 Informal Resolution First
Before filing any legal action, you agree to contact us at contact@jpstreeservice.com and attempt to resolve the dispute informally. We commit to responding within 14 days.
16.4 Small Claims
Either party may bring qualifying disputes in Michigan small claims court without first attempting informal resolution.
16.5 Class Action Waiver
To the extent permitted by law, you agree that any dispute will be resolved on an individual basis, not as a class, consolidated, or representative action.
17. Severability
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.
18. Entire Agreement
These Terms, together with our Privacy Policy and any written service agreement or estimate, constitute the entire agreement between you and JPS Tree Service regarding the Site and services. They supersede any prior agreements or understandings.
19. Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of our Site or services after changes are posted constitutes your acceptance of the updated Terms.
For material changes, we may also notify you via email or a Site notice.
